These Terms & Conditions ("Terms") are an agreement between you and KinFolder ("KinFolder", "we", "us"), the provider of the Kinfolder service at mykinfolder.com (the "Service"). By creating an account or continuing to use the Service, you agree to these Terms. If you do not agree, please stop using the Service.
1. Who may use the Service
You must be of legal age in your jurisdiction to use the Service. If you accept these Terms on behalf of an organization or family group, you confirm you have authority to bind that group. You are responsible for providing accurate account information and keeping it current, for keeping your login credentials confidential, and for all activity that happens under your account.
2. What the Service does
Kinfolder is a private, shared workspace where families record one parent's care information — contacts, health details, care-plan notes, document locations and tasks — and generate printable documents such as an Emergency Snapshot, Appointment Brief, Family Summary, Medication List and Contact Sheet. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have selected.
Kinfolder is an organizational and record-keeping tool. It is not a medical device and does not provide medical, legal, or financial advice. Printed or shared documents are only as accurate as the information you enter, and you are responsible for reviewing them before relying on them or giving them to a clinician, hospital or caregiver.
3. Acceptable use
You agree not to misuse the Service. In particular, you must not:
- use the Service for any unlawful purpose or in violation of applicable law;
- commit fraud, send spam, or impersonate another person;
- upload content that infringes anyone's intellectual property or privacy rights;
- interfere with the security or integrity of the Service — including malware, probing, penetration testing without permission, scraping, or circumventing technical or plan limits;
- reverse engineer, resell, or redistribute the Service;
- store information about a person without a lawful basis or the appropriate authority to do so on their behalf.
4. Your content
You keep ownership of the information you and your family members enter. You grant KinFolder a limited licence to host, process and display that information solely to operate and provide the Service to you and the people you invite. Workspace owners can invite and remove members and delete the workspace; deletion removes the workspace content for everyone in it.
5. Our intellectual property
KinFolder retains all rights, title and interest in the Service, including its software, document templates, documentation, design and branding. Nothing in these Terms transfers any of our intellectual property to you.
6. Service availability
We work to keep Kinfolder available and reliable, but we do not guarantee uninterrupted or error-free performance. Features may change, and maintenance or outages may temporarily interrupt access. Keep your own copies of anything you rely on in an emergency — printing your Emergency Snapshot is the recommended backup.
7. Payments, subscriptions and Paddle
Kinfolder offers a free tier and a paid Premium subscription, billed monthly or annually at the prices shown on our pricing section at checkout. Subscriptions renew automatically for the same period until cancelled, and you can cancel at any time; access continues to the end of the period you have paid for. Applicable taxes are calculated and added at checkout.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, tax, cancellation and refund mechanics are therefore governed by Paddle's Buyer Terms. See also our Refund Policy.
8. Suspension and termination
We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may stop using the Service at any time. When access ends, you will have a reasonable window to export or print your information before it is deleted; after that, workspace content may be permanently removed.
9. Disclaimers and liability
To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Our aggregate liability is limited to the fees you paid in the twelve months before the claim. Nothing in these Terms excludes liability for fraud, death or personal injury where such exclusion is not permitted by law.
You agree to indemnify KinFolder against claims arising from the content you enter, your unlawful use of the Service, or your breach of these Terms.
10. Changes, law and contact
We may update these Terms; material changes will be reflected in the "last updated" date above and, where appropriate, notified in the app. These Terms are governed by the laws of the United States and the state in which KinFolder is established, and disputes will be resolved in the courts of that jurisdiction. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control.
